Hey everyone. I recently had a patent search conducted and the law firm came back and told me that they believe my invention is patentable. Very exciting! Now they’re encouraging me to pursue both a utility patent and a design patent. I’m having trouble wrapping my head around what additional value a design patent adds. If I’m able to get a utility patent, then what risk do I have at the design level. If someone copies my design, so what? They still can’t create a product that copies my utility. I guess they can sell something that looks like my product but has a totally different function? Seems pretty low risk but I’m curious to hear your thoughts. Thank you!
