Is there any one who can explain. There was an application filed for getting a trade mark for an enterprises. After around ten months, the IPO office has raised an objection that the APPLIED MARK (logo/design of trade mark) is: INDISTINCTIVE BEING A PERSONAL NAME & INDISTINCTIVE BEING LETTERS & THERE IS A DISCREPANCY BETWEEN CEO AND SOLE PROPRIETORSHIP SO CLARIFY IT ...................... Q: why IPO department used the word INDISTINCTIVE both for being a Personal name and for being Letters and what Possible answer can be given.whether a trade mark cannot be obtained with the personal name or name of some other near and dear one person but not alive in this world & whether the LETTERS in the mark cannot be used & Whether a new proposed enterprise (sole proprietorship) cannot have the same CHief executive and the Sole proprietor? What explaination/reply to the objections can be given.. Note: the application for getting a trade Mark was filed by a person who would start the enterprise business after getting the trade mark and after getting the registration in the chamber of commerce for exporting the new products manufactured.....(almost ready to be....and in completion process....)..
